These Terms and Conditions ("Terms") govern your use of the Mercury application ("Service") provided by Eillance ("us", "we", or "our"). Please read these Terms carefully before using our Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. The Service

Project Mercury is a peer-to-peer encrypted communication application. The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will always be secure, error-free, or that it will function without disruptions, delays, or imperfections.

2. Your Identity and Data

You are solely responsible for managing your cryptographic identity. This includes securely backing up your 12-word recovery phrase. If you lose your recovery phrase and lose access to your device, your identity cannot be recovered by us or anyone else.

All of your data, including messages, contacts, and identity keys, is stored on your local device. We do not have access to this data. You are responsible for the security of your own device.

To the fullest extent permitted by applicable law, in no event will Eillance, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

We may terminate or suspend your access to our Service's shared resources (like the signaling server) immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. Since all your data is stored locally, termination of service access does not delete your data from your device.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Eillance operates, without regard to its conflict of law provisions.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
